As you will recall, we spoke last summer about the Sound Insulation Program and the Noise contour Map for 2001. I would like the following information:
1. a status on the project
2. timeline for implementation
3. is there a staged approach
4. documentation on the project strategy, i.e. what
specifically will a homeowner receive
5. demographic overview of which communities are included
6. criteria for inclusion in the program
7. entity (person or group) responsible for making the
decision of who is to be included

Mr. Principino:
The SIP [Sound Insulation Program] will potentially be a very long, very expensive, and very complex project. The SIP was approved under the FAR Part 150 Noise Compatibility Program. While we have done a lot of talking with our consultant about the program, nothing has been placed into writing and formalized. Likewise, until this is done and is presented to the Board of Commissioners for their approval, I am hesitant to outline the preliminary plans we have discussed in-house at this time. When we are ready to present this project to the Board and the Board has approved a final plan, I would then be most happy to provide all the information I can.
I know from experience that, if I present anything tentative or in the process of discussion, this will be misconstrued as fact no matter how I try to explain it.

Mr. Remmel,
I'd like clarification please.
Last summer you told me there were maps available and the neighborhoods effected by the SIP had been determined. You invited me to come look at the Noise Contour Map for 2001. Are you now saying this information is no longer available?
Your statement in your e-mail indicated that you have done a lot of talking with your consultant but nothing has been placed into writing or formalized. When will this occur? When will you be presenting the information to the Board of Commissioners for their approval?
Official Code of Georgia Section 50-18-70 states that: "all documents, papers, letters, maps, books, tapes, photographs, computer based or generated information, or similar material prepared and maintained or received in the course of the operation of a public office or agency" are public records. Public records also includes such items when they are received or maintained by a private person or entity on behalf of a public office or agency that are not otherwise subject to a protection from disclosure.
Please cite the specific statutory exemption for not disclosing the requested records. Only that portion of a public record to which an exemption applies is exempt under the Open Records Act (50-18-72)
As you know, the Act requires a response by you within three business days of your receipt of this letter and provides sanctions for non-compliance. I look forward to hearing from you.
