History of Ordinance to Prohibit

Regularly Scheduled Service at PDK

In late 1995 some PDK Watch members suggested having a county ordinance to assure citizens that PDK Airport would not offer regularly scheduled passenger or cargo service. A citizen drafted a proposed ordinance. Here is the course the proposal took.

January 11, 1996: Proposed ordinance presented and discussed at PDK Watch meeting. A neighborhood lawyer along with another citizen volunteered to research and rewrite the ordinance.

January 26, 1996: PDK Watch members discussed ordinance during meeting with CEO Levetan, Airport Director Orvold, and County Attorney Weintraub.

March 7, 1996: PDK Watch members voted at a general meeting to forward a revised ordinance to BOC.

April 8, 1996: Jacq Marie Jack received letter from CEO Levetan saying the ordinance was with legal department.

August 13, 1996: Commissioner Yates presented the ordinance at BOC meeting. It was sent to a work session.

August 20, 1996: The ordinance and changes were discussed at work session.

September 3, 1996: An alternate ordinance written by county’s legal department presented at work session.

September 6, 1996: PDK Watch sent to commissioners a "compromise" ordinance, using language from both the originally proposed ordinance and the legal department's version.

September 10, 1996: "Compromise" ordinance tabled by BOC at meeting.

September 26, 1996: Commissioner Walldorff sent a memo to County Attorney Weintraub with copy of "compromise" ordinance and requested his review.

October 11, 1996: Legal department responded to Commissioner Walldorff with a 2nd draft of their proposed ordinance.

October 27, 1996: PDK Watch requested Commissioner Walldorff to get specific objections from county attorney.

March 10, 1997: Commissioner Walldorff met with PDK Watch representatives to discuss strategy.

June 19, 1997: Larry Foster and David Green met with lawyer about reviewing draft ordinance.

October 28, 1997: Commissioner Yates asks lawyer to review draft ordinance.

April 22, 1999: FAA says a county policy of no scheduled cargo or passenger service at the airport would be in conflict withgrant assurances signed by the county when accepting federal funds.

June 10, 1999: CEO Levetan directs legal department to draft an ordinance to prohibit scheduled service into PDK.

August 10, 1999: Commercial Aircraft Ordinance, which really deals with weight limit not commercial service, is added to the agenda for the BOC meeting. The Commissioner Jacquie Scott requests the item go normal course (wait two weeks to vote).

August 24, 1999: BOC defers vote on Commercial Aircraft Ordinance until the first meeting in October.

October 12, 1999: BOC tables the Commercial Aircraft Ordinance indefinitely.
